Which data is collected can be seen from the respective input forms. Your customer account can be deleted at any time by sending a message to the above-mentioned address of the controller. We store and use the data you provide for contract processing. 6) Use of your data for direct marketing

6.1 Registration for our email newsletter

6.2 Newsletter dispatch via Newsletter2Go

Our email newsletters are sent via the technical service provider Newsletter2Go GmbH, Köpenicker Str. 126, 10179 Berlin ("Newsletter2GO"), to whom we pass on your data provided during newsletter registration. This transfer is made in accordance with Art. 6 para. 1 lit. f GDPR and serves our legitimate interest in the use of an effective, secure and user-friendly newsletter system. The data you enter for the purpose of receiving the newsletter (e.g. email address) is stored on Newsletter2GO's servers in Germany.

Newsletter2GO uses this information for sending and statistically evaluating the newsletters on our behalf. For the evaluation, the sent emails contain so-called web beacons or tracking pixels, which are single-pixel image files stored on our website. This makes it possible to determine whether a newsletter message has been opened and which links, if any, have been clicked. With the help of so-called conversion tracking, it can also be analysed whether a predefined action (e.g. purchase of a product on our website) has taken place after clicking the link in the newsletter. Technical information is also collected (e.g. time of retrieval, IP address, browser type and operating system). 6.3 Registration for text marketing

We use the EU-based SMS platform in the USA, which is operated by SMSBump, 400 Lafayette Street, New York, NY 10003, USA ("SMSBump"). SMSBump is a subsidiary of the US company Yotpo. SMSBump provides an app on the Shopify platform for SMS marketing. You can find SMSBump's privacy policy here: https://smsbump.com/page/privacy-policy. If you sign up for our text marketing and notifications during the checkout process, you agree to this data processing.

By entering your phone number at checkout and initiating a purchase, signing up via our subscription form or a text message, you agree that we may send you SMS notifications (about your order including abandoned cart reminders) and text marketing offers. You acknowledge that consent is not a condition for any purchase.

Your phone number, name and purchase information will be processed on the platform operated by SMSBump. Our data processor SMSBump will only use your data records to send you targeted marketing messages and notifications. After sending the SMS, your phone number will be passed on to an SMS service provider to carry out the delivery.

After your registration, G.N.A. UG will only have access to the data in the following cases:

    • to respond to your reply messages to us
    • to send you text marketing messages.

Our legal basis for processing your personal data for these purposes is your consent (Art 6 para. 1 lit. a GDPR) for text marketing. foodsbest GmbH has concluded EU standard contractual clauses with SMSBump as a data exporter and takes appropriate measures to comply with the provisions of the GDPR for data transfers from the EU.

If you wish to stop receiving text marketing messages and notifications, please reply STOP to any mobile message we send or use the unsubscribe link we have provided in each of our messages. You understand and agree that other methods of opting out, such as using alternative words or requests, may not be offered. Message and data rates may apply.

If you unsubscribe, SMSBump will continue to store your phone number as required by law. Specifically, this means that SMSBump will then store your phone number on a separate list (blacklist) on its server to ensure that SMSBump no longer contacts this phone number for marketing purposes. SMSBump does not pass on this phone number. We have access to this list and can add or delete individual entries. The legal basis for this storage is our legitimate interest in accordance with Article 6 para. 1 lit. f GDPR. As long as the phone number is stored there, you can easily re-subscribe by sending an SMS with "UNSTOP" from this number. 7) Data processing for order processing

7.1 To process your order, we work with the following service provider(s), who support us wholly or partially in the execution of concluded contracts. Certain personal data will be transmitted to these service providers in accordance with the following information.

The personal data collected by us will be passed on to the transport company commissioned with the delivery within the scope of contract processing, insofar as this is necessary for the delivery of the goods. We pass on your payment data to the commissioned credit institution within the scope of payment processing, insofar as this is necessary for payment processing. When paying via PayPal, credit card via PayPal, direct debit via PayPal or - if offered - purchase on account or "installment payment" via PayPal, we transfer your payment data to PayPal (Europe) S.a.r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter PayPal) as part of the payment processing. 12) Duration of storage of personal data

The duration of the storage of personal data is determined by the respective statutory retention period (e.g. retention periods under commercial and tax law).
